Over £250,000 in compensation after liability was admitted

In 2023, Kurt was travelling in a vehicle which was involved in a serious collision with another vehicle.  Kurt lost consciousness at the scene and was taken by ambulance to hospital in Birmingham. 

He was initially assessed to have a pelvic injury, knee fractures, spinal injury, and a moderate brain injury.  Fortunately, most of his injuries could be treated conservatively, but he did require some surgery.  After around a month, he was discharged home.

Losing mobility and independence

Initially, Kurt could not put any weight on his legs and used a wheelchair to get around.  In time, Kurt was advised to begin weight-bearing by his surgeon and offered some NHS physiotherapy.  At this time, he could dress independently but needed help from his partner with bathing, as well as general support around the home.

Early rehabilitation and interim payments

After we began representing Kurt, we notified the vehicle insurers of the claim. We arranged with them to jointly instruct an independent case manager to assess his immediate needs; based on their report, we arranged privately funded physiotherapy, occupational therapy, and counselling.

The insurer took time to investigate liability, so while Kurt was off work, we secured interim payments of over £35,000 and obtained the evidence needed to support his claim.  This included expert medical evidence from an orthopaedic surgeon, neurologist, ENT surgeon and a psychologist.

In the end, the insurer conceded liability, and the case settled after negotiations for over £250,000, which compensated for Kurt’s injury, and financial losses such as lost earnings and pension, and treatment costs.
