At the time of his accident, our client, aged 50, who worked in transport and logistics, sustained a traumatic brain injury and complex musculoskeletal injuries when he fell around 2 metres from a truck whilst unloading it.
His serious injuries included a number of brain bleeds, along with facial fractures, and fractures and dislocations affecting his elbow joint and fingers. He also suffered a psychological impact from the incident, which manifested in flashbacks and nightmares.
How we supported his recovery
Following discharge from hospital, we arranged for a case manager and multi-disciplinary team of treating therapists to be engaged on a joint basis with the employer's insurer. This was all funded under the Rehabilitation Code, which encourages parties to cooperate in providing early, privately funded rehabilitation.
Our client received specialist therapy and input from specialists in orthopaedics, physiotherapy, neuropsychology, and occupational and vocational rehabilitation. Funding for gym membership, plus aids and equipment to help at various stages of his recovery, was also provided. Despite this rehabilitation, he was left with some ongoing disabilities. However, he was still able to return to work, albeit with adjustments.
How the claim was settled
The employer's insurer argued contributory negligence, alleging that our client was partly responsible for his fall. However, following negotiations at a joint settlement meeting between the parties, an amicable settlement of the matter was reached in the sum of £195,000.
