Dennis* was a passenger in a car when the driver lost control. Their vehicle came off the road, and, in the impact, he suffered serious injuries to his lower back.
Dennis was taken to the local trauma centre and had surgery to fuse the fractures in his spine.
Initial challenges and how we supported
After some initial physiotherapy in the hospital, Dennis was well enough to be discharged home. He continued receiving physiotherapy and also used a Zimmer frame to help him get around.
He initially found lying down uncomfortable and, when not using any aid, could not walk for more than 10 minutes at a time. He also had difficulty standing or sitting for a long time. With these restrictions, he was unable to return to work and relied on help from his family with some personal care and household chores.
We contacted the driver’s insurers and received a prompt admission of liability before securing an early interim payment to help cover his lost income. We also obtained expert evidence that recommended further treatment and were optimistic about Dennis’ overall prognosis.
Outcome
In due course, the insurer made an offer, which we negotiated upwards, and Dennis agreed to a significant settlement of over £100,000. This would cover his remaining treatment needs and provide compensation for his injuries and losses.
