The extension of Fixed Recoverable Costs (FRC) came into effect on 1 October 2023 for any non-personal injury claim issued from that date. The extension introduces a new intermediate track for the majority of civil claims valued at between £25,000- £100,000 in addition to the small and fast tracks for claims up to £25,000.
Whilst there are some exemptions relating to length of trial, complexity of evidence and expert evidence, the majority of claims between £25,000 and £100,000 will be allocated to the new intermediate track. Within the intermediate track there are four complexity bands to which cases will be allocated. Within each band the recoverable costs, which any party can receive from the other party, are fixed in accordance with the stage reached at the point of settlement.
