The challenges after negligent cosmetic surgery
Jess consulted a cosmetic surgeon requesting a full abdominoplasty and liposculpture. During the consultation, the surgeon failed to fully explain the risks associated with undergoing a full abdominoplasty. Importantly, Jess consented only to a full abdominoplasty, not a mini abdominoplasty, and she was very specific about this, in line with the research she had done.
During surgery, a mini abdominoplasty was performed instead of the full procedure requested. Additionally, a procedure known as a Fleur de Lis was possibly attempted - a technique that was neither discussed with Jess nor consented to.
The postoperative outcome was poor. There was no discernible improvement in Jess’s appearance compared to her preoperative state. She was left with redundant skin, abdominal bulging, persistent muscle separation, and an unsatisfactory abdominal contour. Due to the surgeon’s negligence, Jess endured a difficult complaint process where the surgeon failed to take accountability for his actions, and a painful corrective procedure with a different surgeon to put things right. Jess experienced significant psychological trauma as a consequence.

The surgeon denied liability, maintaining that the treatment provided met a reasonable standard, that all relevant risks and alternative procedures had been discussed with Jess, and that she had consented to the Fleur de Lis procedure. The surgeon continued to deny liability, and the matter became advanced in Court proceedings; however, Elizabeth ensured that clear and compelling evidence was presented to challenge this position.
