Claim for bereavement award under the Fatal Accidents Act 1976

Georgina * was seriously injured in a road traffic collision and tragically died later leaving behind her partner. 

Apart from the personal loss, her partner also suffered a financial loss with Georgina’s death, as she had contributed to their household income.  They also lost all the help that Georgina had contributed to running their home.

We notified the insurers with the claim details.  Her partner was able to claim a bereavement award under the Fatal Accidents Act 1976, as well as a dependency claim for the loss of Georgina’s income, and the loss of her help with maintaining their home.  A claim was also made for George’s pain and suffering before she died, and the funeral expenses.

Challenges and the outcome

Liability was disputed so we had to get hold of the police evidence. After we received it, we maintained that the driver was to blame. Meanwhile, we gathered the necessary evidence to support the claim, including full details of the financial loss and help that Georgina’s partner was no longer getting. When our fatal injury lawyers began negotiations, we managed to achieve a final settlement of £260,000. The money will never make up for the loss of Georgina, but it will provide her partner with financial security.
