As Principal Associate I specialises in a range of contentious insolvency matters and director disqualification to include;
- Acting for Insolvency Practitioners in respect of claims arising under the Insolvency Act 1986 (βIAβ) and the Companies Act 2006, including antecedent transaction claims, misfeasance claims, wrongful and fraudulent transaction claims and wider asset recovery.
- Defending misfeasance and breach of duty claims brought by liquidators.
- Presenting and opposing applications for charging orders.
- Presenting and opposing and order for sale and possession applications.
- Presenting and opposing statutory demands and bankruptcy petitions.
- Applications to annul bankruptcy orders.
- Pursuing and defending applications brought by trustees pursuant to sections 339, 340, 366 and 423 IA.
- Defending director disqualification claims.
- Acting for directors in respect of section 17 CDDA Permission to Act applications.
Experience
- I have successfully defended a number of office holder claims, to include a £1M claim brought by an administrator of a company for misfeasance and breach of fiduciary duties.
- I have acted on several successful cases defending director disqualification claims.
- Successfully obtained permission for a number of clients who were subject to director disqualification bans.
- I have also successfully acted for a number of Insolvency Practitioners in pursuing financial claims against former company directors.
