Peter Humpherson

Partner - Property Litigation

"I am a specialist property litigation lawyer who is instructed on a wide variety of commercial and residential property-related issues.”

I am a partner at Higgs LLP, specialising in property litigation within the wider dispute resolution department.

I am instructed on a wide variety of commercial and residential property disputes, be it providing advice to clients on how to head off risks before they happen, running matters through the litigation process including to trial, or engaging in Alternative Dispute Resolution.

I completed the Bar Vocational Course in 2004 and was called to the Bar in 2005. Prior to my cross-qualification as a Solicitor in 2012, I worked as a self-employed advocate for over 7 years and represented many prominent institutions in Court, before both District and Circuit Judges. I have worked on cases being heard in the Court of Appeal and the Supreme Court.

I am therefore extremely experienced in Court procedure and I am able to provide practical advice to my clients as to how disputes may play out in Court. I am a confident advocate and more than happy to represent my clients in Court hearings with a view to saving them the costs of instructing Counsel.

  • Acting on a matter in the Supreme Court, representing a Middle Eastern property asset company in dispute with a foreign government.
  • Representing a property development company in the Court of Appeal in a dispute with their security provider.
  • After a six-day trial, succeeding in bringing a claim for a breach of our clients’ right of way, and damages for trespass; the neighbour in particular having installed an unlocked gate along the land in question.
  • After the issue of Court proceedings, settling a highly complex and contested boundary dispute at mediation – securing our clients’ aims at every point along the boundaries in question.
  • On a complex multi-party matter involving substantial damage caused to a commercial premises, securing a settlement which resulted in the client having to make no payment to the claimant, despite Counsel providing very negative advice as to prospects.
  • Successfully defeated a six-figure dilapidations claim on a commercial property and, in turn, securing a six-figure compensation payment for the client.
  • Successfully securing the dismissal of the opponent’s interim injunction application, and subsequently succeeding in a series of applications in response – with the opponent being ordered to make a substantial payment of our clients’ costs.

"Peter played a tactical blinder on the matter, from start to finish. He set the case up to win from the first letter he sent. Some of the calls Peter made along the way took real nerve but they paid off"
