The Charities Act 2022 is progressing through the legislative process and its provisions will start to come into effect later this year.
The implementation of the Act will spark some significant changes in the charity sector and Higgs LLP’s experts are ready to guide you on how this will impact your charity.
Royal Assent was received for the Bill in February and, although the provisions have not yet come into effect, trustees and those involved with charities should get to grips with the changes now so they can prepare and plan accordingly for future projects.
The sector has been calling for change for years on the basis that certain areas of charity law were overly complex, administratively burdensome and resource intensive.
An extensive Law Commission review, ‘Technical Issues in Charity Law’, together with its report in 2017 largely supported voices in the sector with 36 of 43 recommendations accepted by the Government. The head of Higgs’ Charity and Not for Profit team, Kirsty McEwen, was involved in the working party that reviewed the Law Commission’s recommendations.
The Charities Act 2022 came out of that review and aims to reduce administrative pressures, saving time and money. The Act will be implemented gradually to allow trustees time to understand the changes and the Charity Commission to update and create new guidance.
